Terms of Service

1. General

These General Terms and Conditions (GTC) for the provision of services apply to contracts concluded between the Client and the Contractor. Further contractual documents take precedence over these GTC in case of conflict. Deviating terms from the Client are not recognized unless expressly agreed in writing.

2. Agreement to Terms

By accessing or using the ROXBASE service, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

3. Description of Service

ROXBASE provides the following services:

• Fitness level analysis based on race results or estimated baselines
• Personalized, adaptive training plan creation for HYROX
• Pacing targets and race-day split calculations
• Performance tracking against over 1 million race results
• Dynamic plan adaptation based on logged workouts
• Workout alternatives based on available equipment
• Benchmark comparisons and performance insights

4. Account Terms

You must provide accurate and complete information when creating an account. You must be at least 18 years of age to use this service. You are responsible for maintaining the security of your account and password. You acknowledge that you are physically capable of participating in training programs or will consult a medical professional before starting.

5. Medical Disclaimer

The training plans, fitness advice, and recommendations provided by ROXBASE are for informational and educational purposes only. They do not constitute medical advice. Always consult with a qualified healthcare professional before beginning any new exercise program, especially if you have existing health conditions.

You assume all risks inherent to physical exercise and training. ROXBASE is not responsible for any injuries, health complications, or adverse effects that may result from following the training recommendations provided through the service.

6. Subscription and Payment

Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). Prices are subject to change with 30 days' prior notice. Subscription fees are generally non-refundable except as required by applicable law.

7. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

8. User Conduct

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the service
• Interfere with or disrupt the integrity or performance of the service
• Share your account credentials with third parties
• Reproduce, duplicate, or resell any portion of the service without permission

9. Intellectual Property

The service, including all content, features, and functionality, is owned by Zenon Technologies AG and is protected by international copyright, trademark, and other intellectual property laws. Training plans generated for you are licensed for personal use only.

10. Privacy and GDPR

Your use of the service is also governed by our Privacy Policy. We process personal data in compliance with the EU General Data Protection Regulation (GDPR) and applicable Swiss data protection laws.

11. Email Communications

By creating an account, you agree to receive service-related emails including training updates, performance summaries, and product announcements. You can opt out of non-essential communications at any time.

12. Limitation of Liability

To the maximum extent permitted by law, Zenon Technologies AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the service.

13. Indemnification

You agree to indemnify and hold harmless Zenon Technologies AG from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these terms.

14. Third-Party Services

The service may contain links to or integrations with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services.

15. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the service with at least 30 days' notice. Continued use of the service after changes constitutes acceptance of the new terms.

16. Data Protection

All personal data is processed in accordance with our Privacy Policy and applicable data protection regulations including GDPR and Swiss FADP. We implement appropriate technical and organizational measures to protect your data.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Cham, Canton of Zug, Switzerland.

18. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
