Terms of Service

These General Terms and Conditions (GTC) apply to contracts concluded between the Client and Zenon Technologies AG, ROXBASE, Hinterbergstrasse 16, 6312 Cham, Switzerland (hereinafter the "Contractor" or "we") for the provision of fitness training services.

1. General

1.1 These General Terms and Conditions (GTC) for the provision of services apply to contracts concluded between the Client and the Contractor with inclusion of these GTC.

1.2 If, in addition to these GTC, further contractual documents or other terms and conditions in text or written form have become part of the contract, the provisions of such further contractual documents shall take precedence over these GTC in the event of any conflict.

1.3 Deviating terms and conditions used by the Client are not recognized by the Contractor—unless expressly agreed otherwise.

2. Agreement to Terms

By accessing or using ROXBASE ("Service") operated by Zenon Technologies AG ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

3. Description of Service

ROXBASE is a HYROX training platform that:

  • Analyzes your current fitness level and HYROX race results
  • Creates personalized training plans based on your goals and schedule
  • Provides station-by-station pacing targets
  • Tracks workout performance and progress over time
  • Adapts training plans based on your performance
  • Offers equipment-adjustable workout alternatives
  • Provides performance benchmarks and gap analysis

4. Account Terms

  • You must provide accurate and complete information
  • You must be at least 18 years old
  • You are responsible for maintaining account security
  • You are responsible for all activities under your account
  • You may not use the Service for any illegal purposes
  • You acknowledge that you are physically capable of participating in training programs

5. Medical Disclaimer and Assumption of Risk

IMPORTANT - PLEASE READ CAREFULLY:

5.1 Medical Consultation: Before beginning any exercise program, including the training plans provided by ROXBASE, you should consult with your physician or other healthcare provider. This is particularly important if you:

  • Have any medical conditions or health concerns
  • Are taking any medications
  • Have a history of heart disease or high blood pressure
  • Have experienced chest pain, dizziness, or fainting
  • Have any musculoskeletal problems or injuries
  • Are pregnant or postpartum

5.2 Not Medical Advice: The training plans, fitness advice, and recommendations provided by ROXBASE are for informational and educational purposes only. They do not constitute medical advice and should not be relied upon as a substitute for professional medical consultation, diagnosis, or treatment.

5.3 Assumption of Risk: You acknowledge and agree that participation in physical exercise and training programs involves inherent risks, including but not limited to: muscle strains, sprains, fractures, cardiac events, and other injuries. You voluntarily assume all such risks and agree that ROXBASE and Zenon Technologies AG shall not be liable for any injuries or damages you may sustain.

5.4 Listen to Your Body: You should immediately discontinue any exercise if you experience pain, dizziness, shortness of breath, or any other concerning symptoms, and seek medical attention if necessary.

6. Subscription and Payment

6.1 Subscription Plans: ROXBASE offers various subscription plans with different features and pricing. Specific plan details and pricing are available on our website.

6.2 Billing:

  • Subscription fees are billed on a recurring basis (monthly or annually as selected)
  • If you subscribe through the Apple App Store or Google Play Store, billing is managed entirely by Apple or Google respectively under their own terms. Your payment method on file with Apple or Google will be charged.
  • If you subscribe directly through our website, payments are processed securely through our payment provider and you authorize us to charge your payment method on a recurring basis.
  • You must provide current, complete, and accurate billing information
  • Prices are subject to change with 30 days notice

6.3 Refunds:

  • Apple App Store purchases: Refunds are handled exclusively by Apple. ROXBASE cannot issue refunds for purchases made through the App Store. To request a refund, visit reportaproblem.apple.com or see Apple's refund support page.
  • Google Play purchases: Refunds are handled exclusively by Google. ROXBASE cannot issue refunds for purchases made through Google Play. To request a refund, visit Google Play's refund policy page.
  • Direct / web purchases: Subscription fees are generally non-refundable except as required by law or as otherwise specified in our refund policy.

7. Cancellation and Termination

  • You may cancel your subscription at any time through your account settings or through the platform you used to purchase
  • Apple App Store subscriptions: Must be cancelled directly via Apple. Go to iPhone Settings → your name → Subscriptions, or visit Apple's subscription cancellation page.
  • Google Play subscriptions: Must be cancelled directly via Google Play. Visit play.google.com/store/account/subscriptions or see Google Play's cancellation guide. Note: uninstalling the app does not cancel your subscription.
  • Cancellation takes effect at the end of the current billing period
  • We may terminate or suspend your account for violations of these Terms
  • Upon termination, your right to use the Service ceases immediately
  • We reserve the right to delete your data after account termination in accordance with our data retention policies

8. User Responsibilities and Conduct

8.1 You agree to use the Service responsibly and in accordance with these Terms. You agree NOT to:

  • Share your account credentials with others
  • Use the Service to provide training services to third parties
  • Reverse engineer, decompile, or attempt to extract source code
  • Copy, modify, or distribute any part of the Service
  • Use the Service in any way that violates applicable laws or regulations

8.2 You are responsible for the accuracy of information you provide, including fitness assessments, race results, and workout logs.

9. Intellectual Property

9.1 Our Property:

  • The Service, including training algorithms, workout libraries, and all original content, remains our exclusive property
  • The Service is protected by copyright, trademark, and other intellectual property laws
  • Our trademarks and branding may not be used without written permission

9.2 Your Data:

  • You retain ownership of your personal data and fitness information
  • You grant us license to use your data to provide and improve the Service
  • We may use aggregated, anonymized data for research and service improvement

10. Privacy and Data Protection

Your use of our Service is governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described in the Privacy Policy. We comply with all applicable data protection regulations, including GDPR.

11. Email Communications

By signing up for ROXBASE, you agree to:

  • Receive transactional emails about your account and subscription
  • Receive training plan updates and workout reminders
  • Receive product updates and feature announcements
  • Receive occasional marketing communications about ROXBASE
  • You may unsubscribe from marketing emails at any time
  • Transactional emails cannot be opted out of while you have an active account

12. Disclaimers and Limitations

12.1 No Guarantee of Results:
We do not guarantee specific performance improvements, race times, or fitness outcomes. Results vary based on individual factors including:

  • Current fitness level
  • Consistency in following training plans
  • Nutrition and recovery practices
  • Genetic factors
  • Other lifestyle factors

12.2 Service Availability:

  • The Service is provided "as is" and "as available"
  • We do not warrant uninterrupted or error-free operation
  • We may modify or discontinue features without notice
  • Technical issues may temporarily affect service availability

13. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any injuries, health issues, or medical conditions arising from use of our training plans
  • Our total liability shall not exceed the amount paid by you in the past 12 months
  • Some jurisdictions do not allow limitation of liability, so this may not apply to you

14. Indemnification

You agree to indemnify and hold harmless Zenon Technologies AG, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injuries or damages resulting from your training activities

15. Third-Party Services and Content

The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their terms and conditions.

15a. Advertising Platforms; No Affiliation

ROXBASE may use third-party advertising platforms to promote its Service. However, ROXBASE is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the following companies or their services:

  • Meta Platforms, Inc. — including Facebook, Instagram, and related Meta products
  • Google LLC — including Google Search, YouTube, Google Ads, and related Google products
  • Apple Inc. — including the App Store and related Apple services

All third-party names, logos, and trademarks mentioned are the property of their respective owners. Any reference to these platforms is solely for descriptive purposes and does not imply any affiliation, endorsement, or sponsorship.

16. Modifications to Terms

We reserve the right to modify these Terms at any time for objectively justified reasons (e.g., changes in law, market conditions, or service features). We will notify users of material changes via email or Service notification at least two weeks before the changes take effect. Continued use after changes constitutes acceptance. If you object to the changes, we may terminate your account as of the effective date of the amendments.

17. Data Protection and Confidentiality

17.1 We will treat as strictly confidential all matters that come to our knowledge in connection with providing our services, particularly your health and fitness data.

17.2 In carrying out our services, we comply with all data protection regulations—particularly the provisions of the General Data Protection Regulation (GDPR) and applicable Swiss data protection laws.

18. Governing Law and Jurisdiction

18.1 These Terms are governed by Swiss law, excluding the CISG (UN Convention on Contracts for the International Sale of Goods).

18.2 If you are a merchant, a legal entity under public law, or have no general place of jurisdiction in Switzerland, the parties agree that the courts at the Contractor's registered office (Zug, Switzerland) shall have jurisdiction for all disputes arising from this contractual relationship.

19. Severability

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zenon Technologies AG regarding the Service and supersede any prior agreements or understandings.

21. Information on Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution at: https://ec.europa.eu/consumers/odr

This platform serves as a point of contact for the out-of-court settlement of contractual disputes. The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
